If you do a little digging, you will find that Sun's claims against Mitnick carry no weight at all. They claimed $80 million in damages based on mitnick having solaris source code. If you go to their web site (http://www.sun.com/edu/programs.html) you will find the following:

 Sun firmly believes that students and
 teachers need access to source code
 to enhance their technology learning
 experience. Source code is available
 for qualified educational institutions.

Even if you don't qualify for the free source code, You can get it for $100 - details at http://www.sun.com/edu/solaris/source.html

If ever there was a smoking gun, this is it.
